RECENT ARTICLE IN VANCOUVER SUN

As a result of a recent Vancouver Sun article “Mistrial declared after lawyer channels Carson to mock witness”, we have had several requests for the unpublished “Reasons for Judgment”. A full unedited copy of the Mr. Justice Voith’s reasons can be downloaded here (PDF format)

The reasons for the mistrial implied/suggested by the Vancouver Sun article differs considerably from the judicial reasons. The Vancouver sun article was authored by  Ian Mulgrew published a number of unfounded and disparaging comments about Amrit Toor’s expert evidence in the trial. The Vancouver Sun article attributed the unfounded and disparaging comments to Surrey lawyer, Thomas Harding.

On August 10, 2012 Mr. Harding unequivocally withdrew his comments and apologized to Dr. Toor for his unwarranted and misleading allegations (click here to see “Mr. Harding’s apology to Amrit Toor, Ph.D, P.Eng.”). On August 15, 2012 Mr. Mulgrew and the Vancouver Sun published an apology to Dr. Toor for publishing Mr. Harding’s allegations (click here to see “the Vancouver Sun and Mr. Mulgrew’s apology to Amrit Toor, P.hD, P.Eng.”).

Amrit Toor’s response:

As you can appreciate, articles in respected newspapers (true or untrue) can significantly alter the perception of an individual’s integrity. In each and every assignment I have undertaken, I have always provided impartial, objective and technically sound accident reconstruction services. In light of Mr. Harding’s unequivocal withdrawal of his comments, I hope the negative impact of the Vancouver Sun article is to some degree neutralized.
